PAN Cancels Live Seminars for 2020

Out of concern for the health and safety of our customers and our instructors, PAN is cancelling all live seminars scheduled for the remainder of 2020.

We are in the process of contacting everyone who is registered for one of the cancelled seminars. Registrants will be able to reschedule their seminars for a future date or register for online education.

New Webinar – “RON: What You Need to Know About Act 97 of 2020”

PAN’s latest webinar titled “RON: What you need to know about Act 97 of 2020” will be presented on Friday, November 20th at 11 a. m. and 1 p. m. ET.

Pennsylvania recently passed Remote Online Notarization (RON) into law. The PAN Instructors will talk about the basics of Act 97 and what you need to know to comply with and perform RON. The webinar will consist of a presentation and a period of time for questions following the presentation.

Governor Signs Remote Online Notarization Bill Into Law

On Oct. 29, Gov. Tom Wolf signed House Bill 2370 into law, amending the Revised Uniform Law on Notarial Acts (RULONA) to make remote online notarization (RON) permanent in Pennsylvania.

Act 97 of 2020 is effective immediately.

PennDOT Again Extends Expiration Dates on CDLs, CD Learner’s Permits, and Hazardous Materials Endorsements

Effective September 30, 2020, the following products’ expiration dates were extended for Pennsylvania residents in response to statewide COVID-19 mitigation efforts:

  • The expiration date for a commercial learner’s permit scheduled to expire from March 16, 2020, through November 29, 2020, was extended through November 29, 2020.
  • The expiration date for commercial driver licenses scheduled to expire from March 16, 2020, through November 29, 2020, was extended through November 29, 2020.
  • The expiration date of a Hazardous Materials Endorsement (HME) for an individual who is a Pennsylvania-licensed commercial driver’s license holder and who held a valid, unexpired HME with a determination of no security threat on or after March 6, 2020, was extended until October 29, 2020.

Expiration extension deadlines on non-commercial driver license, photo identification cards, learner’s permits and camera cards expired on August 31.

PennDOT Bulletin on New Registration Plate

Act 48, signed into law on July 1, 2020, has added section 1369.4 of the Pennsylvania Vehicle Code. The following change takes effect on October 29, 2020:

USA Semiquincentennial registration plate. The USA Semiquincentennial registration plate became available on October 29, 2020, and will only be available until December 31, 2026. The plate design reflects the “Family of Plates” color scheme of blue, white and yellow. Pennsylvania is printed at the top and the words “Let Freedom Ring” are printed on the bottom. The plate depicts the image of the Liberty Bell with “1776-2026” above the image and the phrase “250 years” beneath the image.

To apply for this registration plate, please complete Form MV-919, “Application for USA Semiquincentennial Registration Plate.” This registration plate will be available for a motorcycle, a passenger car or a truck with a registered gross weight of not more than 14,000 pounds or a motor home for a fee of $50.

PennDOT Bulletin on Act 64 of 2020

Act 64, signed into law on July 23, 2020, has amended multiple sections of the Pennsylvania Vehicle Code. The following change was effective immediately:

Section 1119(a)(2) has been amended to add an additional exemption to the 90-day provision related to an application for certificate of title by an agent made not more than 90 days before the application is received by the department. Section 1119(a)(2)(IV) states:

  • If the 90th day occurs during a declaration by the governor of disaster emergency under 35 Pa.C.S. § 7301(c) (relating to general authority of governor), a limited power of attorney may be used for the sale, purchase or transfer of manufactured homes during the period of the disaster emergency and for 10 days following the expiration of the disaster emergency.

Also amended by Act 64 is Section 7134, relating to odometer disclosure requirements. This change takes effect on October 21, 2020. This amendment changes Section 7134 in the following ways:

  • Section 7134(a) and 7134(b)(2) no longer includes the word “written” as one of the qualifiers for an odometer disclosure statement.
  • Section 7134(d.1) changes the subsection to be specific to licensed dealers and added that the dealer may use a secure power of attorney (SPOA) to transfer ownership if the title has been lost by the transferor and the licensed dealer is applying for a duplicate title, or if the Manufacturer’s Certificate of Origin (MCO) for a new vehicle is being held by a lienholder.
  • Section 7134 (d.2) was added and allows insurance companies to use a SPOA to transfer a salvage vehicle under the same circumstances as licensed dealers mentioned above. The SPOA does not need to be notarized and may be signed electronically.

The legislation allows an authorized insurance company to use an Electronic Secure Power of Attorney (ePOA). Only an insurance company may use an ePOA. An ePOA is a secure power of attorney, which is executed in an electronic format. An ePOA will use an electronic signature and does not need to be notarized. An ePOA may be used by authorized insurance companies in the same manner as a paper SPOA. The insurance company is responsible for ensuring the ePOA complies with the requirements of 15 U.S.C. § 7001, 49 U.S.C. § 32705 and any other requirements imposed by the Commonwealth. NOTE: The department is unable to accept ePOA forms electronically; these forms must be printed and submitted with proof of ownership documents and motor vehicle applications.
